Official UK procurement notice
Modification of the Traffic Signal Equipment and Intelligent Transport Systems framework agreement without a new procurement procedure
Authority: Warwickshire County Council (Local council)
What is being bought
Published requirement descriptionModification of a contract under Regulation 71(1)(c) of the Public Contracts Regulations 2015 (PCR).
Warwickshire County Council awarded a contract for Traffic Signal Equipment and Intelligent Transport Systems following a competitive procurement exercise. The original contract notice was published on the TED website (2019/S 162-397533) followed by the contract award notice (2020/S 048-114785). The original contract was let by Warwickshire County Council on behalf of itself and two other authorities (Coventry City Council and Nottingham City Council) and has an expiry date (including extensions) of 31/3/2027.
The proposed modification seeks to extend the duration beyond the initial term by a period of 24 months, meaning it will now expire on 31/3/2029. The extension period was not provided for in the originally awarded contract.

This is not an award of a new contract, the purpose of this VEAT notice is to notify the market of our intention to modify the existing contract. Due to the ongoing uncertainty over the Local Government Reorganisation process in which two of the three Authorities who are party to this contract are involved, it is not possible to conduct a procurement exercise at this time as the Council is unable to provide sufficient information to prospective bidders in relation to the future requirements or the number or nature of any successor organisations. The Council therefore believes that regulation 72 (1) (c) applies in that a diligent contracting authority could not have foreseen the Local Government Reorganisation process being undertaken when it originally procured the requirement. The modification does not alter the overall nature of the contract, nor does it increase the value beyond 50% of the original contract.
Publisher note: This is not an award of a new contract, the purpose of this VEAT notice is to notify the market of our intention to modify the existing contract. Warwickshire County Council had originally intended to re-procure this requirement on behalf of itself, Coventry City Council and Nottingham City Council during 2026 however, the inclusion of both Warwickshire County Council and Nottingham City Council in the Government's Local Government Reorganisation process has meant that there is insufficient information available with regards to the future legal entities and their make-up to allow the Council to identify the scope of any future requirement at this time. The partners are unable to confirm to the market who the contract would be with and/or how many authorities maybe created by the process and therefore the Council is seeking to extend the current contractual arrangements in line with Regulation 72 (1) (c) of the PCR2015. The procurement activity (including mobilisation) is anticipated to take 12-18 months from the point at which the Council has sufficient information to commence the procurement activity and therefore a two year extension is proposed to allow for the procurement to be completed in time for a new contract to be implemented from 1/4/29 onwards. The value of the contract to date is significantly below the originally estimated figure of £30M and the Council does not anticipate that this figure will be exceeded during the proposed two year extension period.
