Published requirement descriptionNexus Multi Academy Trust (“Nexus” or “the Authority”) is seeking to establish an Open Framework for the provision of ICT products, services and solutions to the education sector. The Framework is intended to provide Nexus and other eligible Contracting Authorities with a compliant and accessible route to market for the procurement of ICT requirements. The Framework is divided into three Lots: Lot 1 – ICT Support Services and Managed Services Lot 2 – Professional Services Lot 3 – Hardware Suppliers may tender for one, multiple or all Lots. There will be no limit on the number of Suppliers that may be appointed to each Lot. The Framework will operate as an Open Framework in accordance with the Procurement Act 2023 and is intended to be reopened periodically to allow new Suppliers to apply for appointment. The maximum duration of the Open Framework will be eight years. The estimated maximum value of the Framework is £1,000,000,000 excluding VAT over its maximum term. This represents estimated potential expenditure through the Framework and does not constitute a guarantee of expenditure, minimum spend, volume of business or exclusivity. The Framework will be established and operated by Nexus Multi Academy Trust and will be available for use by eligible Contracting Authorities in respect of publicly funded schools and colleges.

The Authority is satisfied that the earlier engagement has not resulted in any Supplier obtaining an unfair advantage and that all Suppliers are able to participate in this Procurement on an equal basis. This Framework Agreement is available for use by public sector education establishments in the United Kingdom being: Academy Trusts established under the Academies Act 2010 (including Single and Multi-Academy Trusts, Free Schools, Studio Schools, and University Technical Colleges); Maintained Schools financed by Local Authorities under the School Standards and Framework Act 1998; Non-Maintained Special Schools approved under section 342 of the Education Act 1996; and Independent Schools registered under section 464 of the Education Act 1996.
Published description of the framework
Contracts may be awarded to successful suppliers with a place on the framework either with or without competition, in compliance with PA23. Any contracts under the framework awarded without competition will be awarded according to mechanisms detailed in the associated tender documents. The Customer is required to award any Call-Off Contract in accordance with the competitive selection process unless the Customer can determine that any of the following apply: a. the estimated value of its Statement of Requirements is below the relevant Procurement Thresholds; b. the Services to which the proposed Call-Off Contract relate are capable of being provided only by the existing Supplier due to an absence of competition, either as a result of the technical nature of the Services or the particular Supplier having the intellectual property rights, and there are no reasonable alternatives to the Services; c. the Services to which the proposed Call-Off Contract relate are intended as an extension to, or replacement of, existing Services in circumstances where a change in supplier would result in the Customer receiving Services that are different from or incompatible with the existing Services, and the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance; and then the Customer may award a Call-Off Contract without a competitive process.
