Aberdeen City Council, acting on behalf of the Partner Councils, has agreed a variation to the Ness Energy Project Emergency Operation and Maintenance Contract with SUEZ Recycling and Recovery UK Ltd.
The existing contract includes extension provisions up to 31 July 2027. The modification extends the contract term beyond that date to 31 January 2028 to maintain continuity of operation of the Ness EfW Facility pending completion of the ongoing competitive procurement for a long-term O&M contract.
The modification is being made in reliance upon Regulation 72(1)(b) of the Public Contracts (Scotland) Regulations 2015.
The procurement timetable currently anticipates replacement arrangements commencing around early 2028.

- Change Aberdeen City Council, acting on behalf of the Partner Councils, has modified the existing Emergency Operation and Maintenance Contract for the Ness Energy from Waste Facility with SUEZ Recycling and Recovery UK Ltd. The modification extends the contract term beyond the existing contractual longstop date of 31 July 2027 to 31 January 2028 in order to maintain continuity of operation of the Facility whilst the Councils complete the ongoing competitive procurement process for a long-term Operation and Maintenance contract. No change has been made to the overall scope or nature of the services being delivered under the contract. The modification relates solely to the continuation of the existing operational and maintenance services currently provided by the incumbent contractor for the period necessary to ensure uninterrupted operation of the Facility and an orderly transition to the successor contract., Need for additional works, services or supplies by the original contractor/concessionaire: The modification is necessary as a change of contractor cannot be made for economic and technical reasons, including the need to maintain interoperability and continuity of operation at the Ness EfW Facility. The incumbent operator currently manages critical operational, maintenance and regulatory arrangements. Appointing an alternate interim contractor for a limited period would require a substantial transfer and mobilisation exercise, including transfer or novation of key operational arrangements, workforce transfer processes and regulatory approvals. A competitive procurement to secure a long-term replacement contract is underway. Re-procuring a separate interim arrangement would result in substantial duplication of cost, procurement effort and implementation activity, creating significant operational and transition risks. The modification is therefore considered compliant with Regulation 72(1)(b) of the Public Contracts (Scotland) Regulations 2015.
