This extension period may be utilised where the renewal procurement exercise is delayed, where there are no suitable tenders or where the procurement is the subject of a legal challenge preventing the award of the contract(s)., Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: This modification is made under the provisions set out in Regulation 72 (1) (c) (i), (ii) and (iii). The need for contract modification has been brought about by the unforeseen circumstances causing delay in the tender process and is required to ensure continuity of contractual cover until the tender process can be concluded.
