Award a contract directly as this approach is allowed under the UCR's where restrictions on the use of IPR do not trigger a requirement to conduct a new OJEU-compliant tender

process.

Regulation 50.(1) Utilities may use the negotiated procedure without prior call for

competition in the following cases-

(c) where the works, supplies or services can be supplied only by a particular economic

operator for any of the following reasons -

(iii) the protection of exclusive rights, including intellectual property rights*

*noting that this applies where no reasonable alternative or substitute exist.
