The services in scope of this procurement are critical to the delivery of public healthcare outcomes as required by legislation, and continuity of provision is essential.\nThe Authority considers that an extension can be entered into as a “permitted modification” in accordance with regulation 13(1)(d) and 13(2) The Health Care Services (Provider Selection Regime) Regulations 2023 (“PSR”). This is on the basis that the modification is attributable to a decision of the Lead Authority, does not render the contract materially different in character and the cumulative change in the lifetime value of the contract will remain less than 25% of the original value.",
