Procedure rationaleThis is a direct award of a software maintenance contract under regulation 32(b)(ii) and (iii) of the Public Contracts Regulations 2015. The ONE system is a proprietary software platform owned by Capita Business Services Limited and separately licensed by Capita to the Contracting Authority. The system was created to be a database capturing statutory Education data. To meet statutory requirements, the Capita ONE system needs to be upgraded triennially, which cannot be achieved without software updates produced only by Capita. The parties have contracted on terms based on a call-off from Framework Agreement Y20023 let by KCS Procurement Services.
