The full commissioning of the incinerator and the software rewrite requires highly specialised expertise. Due to the technical complexity and niche nature of the works, there is an absence of viable competitive alternatives within the market. On this basis, Lührfilter is considered the most appropriate contractor to undertake the required works.

Lührfilter has developed extensive knowledge and system-specific knowledge of the Brooksby incinerator through its involvement in Phase 1 (Investigation and Testing) and Phase 2 (Commissioning Works and Documentation Update). This includes a detailed understanding of the system architecture, control philosophy, and operational constraints. This knowledge is not readily transferable without significant time, cost, and risk. It is therefore critically important to retain this expertise for the software rewrite and final commissioning activities.

Engaging an alternative supplier would introduce significant risks, including duplication of investigative work as any new contractor would require substantial time/cost to familiarise themselves with the system and revalidation activities. In contrast, Lührfilter's existing in-depth knowledge ensures continuity of service, reduces delivery risk, and supports an efficient programme.

In addition, Lührfilter has a proven track record in delivering comparable incinerator systems, including four previous phases of successful works on the ISO11 incinerator since 2015. They therefore have demonstrable expertise in high-risk and high-containment environments, including a strong understanding of bio-containment requirements, operational protocols, and SAPO4 licensing and associated compliance standards.

For these reasons, the proposed direct award to Lührfilter is justified on the basis of absence of competition for technical reasons, continuity requirements, and the need to mitigate significant delivery and operational risks.
