Why no open competition: The procurement falls outside the scope of application of the directive
Published justification: The Framework Agreement set out in OJEU Contract Notice was entered into by EANI as per the published Contract Award Notice (Framework Agreement). The Framework Agreement was initially for a value of £3,450,000. The modified value is up to a maximum of £1,725,000 GBP.
Further additional services until the commencement of the new framework agreement, which were not included in the original procurement, have become necessary and are permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled:
(i) The need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. Namely, EA buses that previously delivered school meals could no longer be used as they were either 1) redeployed to home-to-school runs or 2) EA Transport were unable to recruit drivers or 3) existing drivers refused to provide the service.
(ii) The modification does not alter the overall nature of the contract; and
(iii) Any increase in price does not exceed 50% of the value of the original contract or framework agreement. The upper estimate of the original Framework Agreement was £3,450,000 GBP. date. As the modification to value is estimated to be up to a maximum of approximately £1,725,000 GBP, it does not exceed 50% of the value of the original Framework Agreement.

Publisher note: As this is a framework with all 75 operators placed on framework a nominal value of 0.01 was placed against each operator as some. operators may not be awarded any work however we will not exceed the combined contract values as stated in Annex D.
