Procedure rationaleBabcock Land Defence Ltd, acting as agent for the UK Ministry of Defence, intends to negotiate a 2 year contract plus 2 x 1 year options with Cook Defence Systems Ltd for the supply of Armoured Vehicle Track & Ancillaries. It is considered that this contract can be awarded using the Negotiated Procedure Without Prior Publication pursuant to Regulation 16(1)(a)(ii), Regulation 16(1)(b)(i)(aa) and Regulation 16(1)(b)(i)(bb) of the Defence and Security Public Contracts Regulations 2011).
The UK Ministry of Defence requirement is for the supply of interoperable track and ancillaries for AS90, Bulldog, Challenger 2, CRARRV, CVRT, Terrier, Titan, Trojan, Warrior (WR2 Spec) and Stormer and associated items; this requirement is to facilitate the refurbishment and regeneration of the current fleets whilst the implications of the Integrated Review are reviewed and fully understood. The requirement will be met by placing a framework agreement and subject to the advertised contract value.
Cook Defence Systems Ltd are the original manufacturer and the owner of the design drawings/information and technical specifications required to supply these items. Cook Defence Systems Ltd has confirmed that it has not shared and will not share the technical data with any third party (including the UK Ministry of Defence). Without access to this technical data, the UK Ministry of Defence is not in a position to identify the exact technical requirements for the supply of these items; without this technical data and knowledge these items cannot be produced safely and be fully interoperable with existing track to the exact standards as defined in the original design and specification, thereby compromising the integrity of the product on safety and performance grounds. As a result, Cook Defence Systems Ltd is the only company with the technical knowhow to be able to fulfill this requirement.
This notice is not a request for expressions of interest, but a notice of Babcock Land Defence Ltd (acting as agent for the UK Ministry of Defence) intention to utilise the Negotiated Procedure Without Prior Publication (set out in Regulation 18(2) of the Defence and Security Public Contracts Regulations 2011) to negotiate a single source contract with Cook Defence Systems Ltd. |
