Procedure rationaleEducation services are detailed in Schedule 3 of the Public Contract Regulations 2015 as Social and Other Specific Services and therefore would be deemed to be caught by the Light Touch Regime of the Public Contract Regulations. The Department for Education's position in the High Needs Operational Guidance 2019 - 20 set out: The department's position is that the provision of special educational needs and alternative provision placements forms part of the system of public education which is financed, entirely or mainly, by public funds and supervised by local authorities. Consequently, securing such provision is to be considered as a non-economic activity, with the result that the agreement between a local authority and institution to make SEN provision required by an EHC plan is not regarded as a public service contract for the purposes of the Public Contracts Regulations 2015. Where a child or young person has an EHC plan, placements must be made through the statutory assessment process set out in the Children and Families Act 2014, following the guidance in the Code of Practice.
