Procedure rationaleThe authority is proposing to execute a variation to its residual waste contract with SUEZ Recycling and Recovery UK Ltd (formerly known as SITA GB Limited) dated 2 April 2001 which it awarded following the publication of a contract notice in the Official Journal of the EU in 1999 (Original Contract). The estimated value of the Original Contract was £90m (in 2001 prices).
This will formally extend the contract for a minimum of two years (terminating on 31 March 2028) and for a maximum of five years (with a long stop expiry date of 31 March 2031).
The other minor amendment is to acknowledge the anticipated legislative changes in respect of extension of the UK Emissions Trading Scheme to waste incineration.
The contracting authority is currently in procurement (alongside six other local authorities) for a longer-term contractor to Design, Build, Finance and Operate an energy recovery facility for the treatment and disposal of this waste. This limited contract extension will provide flexibility for the contracting authority and ensure continuity of service provision for
the treatment of non-recycled waste until such time as the successful contractor takes responsibility for the management of the waste under the new longer-term contract.
The contracting authority considers that the modification is permitted by Regulation 71(1)(e) of the Public Contracts Regulations 2015 as a modification which is not substantial. The proposed extension of the contract is based otherwise on substantively the existing terms and conditions and does not render the contract materially different in character, change the economic balance of the contract or considerably extend its scope, The contracting authority does not consider that if the contract had originally been advertised to include this extension that it would have attracted and different participants or candidates or that the outcome of the original procurement would have been any different. |
