Mhs homes is procuring a Framework pursuant to which it is envisaged that contracts will be awarded to Suppliers appointed to the Framework for the provision of Temporary and Permanent Recruitment Agencies. The Framework will be divided into the following lots based on the roles and vacancies to be fulfilled under each.

Published description of the framework

The Framework Agreement will give mhs homes and any other Authorised Users the option to award contracts to Suppliers under the Framework by way of a "Competitive Selection Process" between the framework Suppliers, or by way of "direct selection" of a framework Supplier, without any further competition. Suppliers should refer to the form of Framework Agreement in Appendix 2 for further details of these award procedures.

Review and risk notes
Risks

The following potential risks have been identified which may impact the performance and delivery of the Framework and any resulting Contract. While the likelihood and extent of these risks cannot be determined at the commencement of the Contract, their occurrence may necessitate a contract modification in accordance with the Procurement Act 2023 and the terms of the Framework.

The identified risks include:

  • Changes to legislation, regulation, statutory guidance or other legal requirements during the term of the Contract.
  • Unforeseen changes to service delivery requirements, operational standards or compliance obligations.
  • Advancements or changes in technology, digital platforms, IT systems or related infrastructure.
  • Unanticipated increases in the Contracting Authority's budget, demand, workload or service requirements.
  • Exceptional external events or market conditions that materially affect the cost or delivery of the services, including but not limited to economic instability, significant inflation, public health emergencies, armed conflict or major geopolitical events.
  • Political or governmental changes that impact funding, priorities, service delivery or contractual obligations.
  • Unforeseen increases or decreases in property numbers, asset portfolios, staffing volumes or service volumes requiring support under the Framework.

In the event that one or more of the above risks materializes and has a material impact on the delivery of the Contract, the Housing Association may consider a modification to the Framework or relevant Call-Off Contract.

Any such modification will:

  • Be limited strictly to the extent necessary to address the impact of the relevant risk.
  • Represent a proportionate and reasonable response to the circumstances that have arisen.
  • Not result in an increase in the estimated contract value of more than 50% of the original Contract value.
  • Comply with all applicable requirements of the Procurement Act 2023 and associated regulations.
  • Be notified and published through the appropriate Contract Change Notice to satisfy the Housing Association's transparency obligations.
