      "features": "This Competitive Flexible procurement procedure consists of the following Stages:\n- Participation (Invitation to Participate)\n- Commercial Invitation to Negotiate (Invitation to Tender)\nEach of the above stages are split into specific stages, outlined below. Further details of the procurement process can be found within the tender documentation.\nParticipants who respond to the Tender Notice will be issued with a Procurement Specific Questionnaire (PSQ) as part of the Invitation to Participate (ITP) stage.\nThe PSQ is divided into sections which have Pass/Fail criteria and weighted and scored criteria, details of which are included within the ITP documentation.\nThe Participant's PSQ submission will be evaluated in accordance the criteria set out in the ITP documentation.\nIf the Participant's PSQ submission meets the stated minimum criteria set out in the ITP documentation, then LNER proposes to invite the Participant to progress to the Invitation to Negotiate (ITN) stage of this procurement.\nIf the Participant's PSQ submission does not meet the stated minimum criteria set out in the ITP documentation, then the Participant will not be taken forward to the ITN stage of the process.\nThe ITN stage of the procurement process has three main phases which are described fully in the ITN documentation:\n• The Initial Submission and Negotiation Phase.\n• The Best and Final Offer Phase.\n• The Governance, Award and Mobilisation Phase.\nA comprehensive evaluation process will be followed to determine the Most Advantageous Tender (MAT) submission from this ITN process, evaluating submissions against categories and weightings included within the ITN documentation.\nFollowing evaluation of all Bidder's submissions, the negotiation stage will commence, which aims to refine the terms and conditions, ensure that the Technical responses align with the ITN requirements and provide an opportunity to enhance commercial propositions ensuring the contract meets both parties' expectations.\nAll Bidders who were involved in the Negotiation process will be invited to submit a Best and Final Offer (BAFO) for the Pricing element only, incorporating any negotiated changes.\nFollowing the ranking of BAFO responses, LNER will select the Preferred Bidder based on the highest combined evaluation score.\nLNER reserves the right to award the Lot based on the result of the initial ITNs.\nTo register your interest in this notice and receive the Invitation to Participate documents you should submit an expression of interest to the contact organisation, via the details shown within this notice and request a copy of the Invitation to Participate Documentation.\nSubject to Section 31 of the Procurement Act 2023, LNER reserves the right to amend, supplement, waive, withdraw or terminate any or all this ITN at any time without notice being given to Bidders, or to re-invite submissions on the same or any alternative basis.\nAll compliant submissions at the ITN stage will be fully evaluated and a contract awarded to the Most Advantageous Bidder, in line with the evaluation criteria detailed.\nAdditional information\nWhere used throughout this notice, the meaning of Train Operating Companies includes all and any of those train operating companies who, currently or in the future, provide services for the carriage of passengers by railway:\na) under a franchise agreement with the Secretary of State within the meaning of section 23(3) of the Railways Act 1993 or b) under, or secured under, the Secretary of State's duty in section 30(1) of the Railways Act 1993; or\nc) in accordance with legislation which supersedes or amends the powers referred to in a) and b),including where such powers are transferred from the Secretary of State to another body.\nThe list of current providers of services for the carriage of passengers by railway under these provisions can be found at:\nhttps://www.gov.uk/guidance/public-register-of-rail-passenger-contracts.\n(https://www.gov.uk/guidance/public-register-of-railpassenger-contracts.)\nNovation or Assignment\nThe contract may be novated or assigned by London North Eastern Railway Limited to Train Operating Companies, or to DFT Operator Limited (company number: 07141122) or any successor parent company to a Train Operating Company, following a corporate restructuring or similar circumstance."

    "description": "London North Eastern Railway Limited (hereinafter LNER) is running this procurement for bulk fuel supplies for its Clayhills Depot in Aberdeen, which supports LNER's operational and engineering activities in the North of Scotland, under the competitive flexible procedure pursuant to sections 19 and 20 of the Procurement Act 2023.\nThe estimated annual volume of product is 6,200,000 litres - Product Specification: Gas Oil to BS EN590 Diesel for use in UK Railway vehicles.  Dyed for off road purposes.\nLNER is a long distance passenger train operator providing intercity services on the East Coast Main Line, connecting London King's Cross with destinations across Yorkshire, the North East and Scotland.\nLNER has been publicly owned and operated by the Department for Transport's Operator of Last Resort since 24th June 2018 and is a wholly owned subsidiary of DfT Operator Limited (DfTO). \nLNER operates within a public sector governance framework and works closely with its suppliers to deliver safe, reliable and value for money rail services.\nDFTO is committed to working closely with all aspects of the rail industry to ensure the continued provision of critical passenger rail services.\nFPA Consulting Limited (hereinafter referenced as FPA) has been employed by LNER to act as procurement consultant and advisor to LNER for this procurement. In the event of a contract award, the successful Bidder will enter into a direct contract with LNER and not FPA.\nLNER proposes to enter into one contract with the successful Bidder for a 12-month period from 1st April 2027 with contract extension options for a further period of 12-months followed by 12-months giving a maximum potential period of 36-months.",
