Procedure rationaleThe University currently occupies several properties adjacent to its' campus in the centre of Hendon, North London, which it rents from the London Borough of Barnet (LBB). The University has been working with LBB on regeneration proposals for the centre of Hendon in an area known as The Burroughs (referred to as the Hendon Hub Project). This involves bringing forward development across a number of sites within the area, including those currently occupied by the University under leases from LBB.
As part of the Hendon Hub Project, the University now intends to surrender its current leases and enter into arrangements for new forty year leases with LBB for the construction of new academic buildings and student accommodation. This will enable the University to consolidate its campus as part of LBB's wider vision for the Hendon Hub Project. These arrangements are being agreed between LBB and the University under a proposed development agreement in relation to the relevant sites. Pursuant to the development agreement LBB will undertake the construction works and all associated drainage, landscaping, road formation and infrastructure works to provide these new academic buildings, student accommodation and ancillary facilities as part of the wider Hendon Hub Project and enter into new leases with the University for those sites once construction is complete.
It would not be possible for the University to enter into the development agreement with any counterparty other than LBB given both the LBB exclusive rights in the relevant land interests and for technical reasons associated with the Hendon Hub Project being led by LBB. For those reasons, to the extent the development agreement could be considered a public works contract or otherwise subject to the Public Contracts Regulations 2015, the University is satisfied it would be exempt from those rules on the basis of Regulation 32(2)(b) (Use of the negotiated procedure without prior publication). |
