What is being bought
Derby City Council requires a contract for shop fitting services for the Market Hall, Derby. The Market Hall is currently undergoing a major refurbishment project, which is due to complete in Spring 2025. Once the project is complete, the market stalls will require occasional refit on change of stall-holder. Derby City Council intends to contract with M Howells (Services) Ltd for a new contract to provide shop fitting works services. Procedure rationaleAward of a contract without prior publication of a call for competition in OJEU as the procurement falls outside the scope of application in accordance with Article 32ii of Directive - competition is absent for technical reasons. The Council is proposing to contract with M Howells (Services) Ltd to provide shop fitting services as the company are the only provider able to support this service. The Council requires shop fitting works to the Market Hall and the new contract will allow works to the newly refurbished market stalls. It is essential that the continuation of the design philosophy and look and feel of the refurbishment project to ensure the Market Hall remains visually appealing to customers and tenants. M Howells (Services) Ltd are currently providing shop fitting services to the main contractor on the refurbishment contract. Shop fitting is a specialist field with limited supply available both in the locality and for the volume of works required. Additionally, a change of supplier at this time would require additional resourcing for specification and with no guarantee of the continuity of the look and feel required. It is proposed to directly award a contract to M Howells (Services) Ltd without prior publication of a call for competition. In taking this route to market the Council hereby issue this VEAT notice. The contract term will be two years with three optional one year extensions if required. The Council will observe a 10-day standstill period.
