Procedure rationaleDefence General Munitions Team (DGM PT), which is part of the United Kingdom Ministry of Defence (UK MOD) is intending to place a Contract with EPA Manufacturing Limited for the procurement of Non-Service Pattern Light Weapon (NSPLW) Ammunition. This includes the procurement of rifle and machine gun natures and pistol rounds that will be used for familiarisation training of UK and overseas forces prior to Operations. The estimated total value of the procurement is £2,000,000 ex-VAT, with a Contract duration of 2-years firm with 5 years of options. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(i) of the Defence and Security Public Contracts Regulations 2011) – Absence of tenders or suitable tenders. The NSPLW natures were originally advertised via the competition DGM/1965 as Lot 2 and Lot 3. However, due to an absence of tenders or suitable tenders, the Authority now intends to obtain these natures from the only tenderer for these lots under DGM/1965, EPA Manufacturing Limited, via a single source contract under the non-competitive negotiated procedure. The Authority considers that it is possible to receive the assurances necessary to award the contract to this supplier through negotiation, without materially changing the scope of the tender initially issued under DGM/1965
