Why no open competition: The works, supplies or services can be provided only by a particular economic operator due to absence of competition for technical reasons
Published justification: The Welsh Government has concluded the procurement process for the award of the Apprenticeship Commissioning Programme, which was conducted in accordance with the Public Contracts Regulation 2015 ("The PCR”). None of the successful tenderers provide niche construction apprenticeships or can currently support continuing scaffolding apprentices. Save for CITB, no other third party organisation including unsuccessful tenderers can support the delivery of the niche construction apprenticeships required by WG. If WG do not award this contract; 1) 39 learners currently placed with CITB will become displaced learners, 2) Welsh learners will be excluded from accessing niche construction apprenticeships. For these reasons, the WG wishes to award a contract directly to CITB, for the delivery of niche construction apprenticeships in addition to supporting scaffolding apprentices continuing into the 2021/22 contract year, in accordance with regulation 32(2)(b)(ii) (Use of the Negotiated Procedure without Prior Publication) of the PCR.
