Procedure rationaleThe Supreme Court ruled that day care services in England are required to pay VAT and are not considered “state regulated”. Following this judgement, HMRC issued VAT Brief 9 declaring that retrospective VAT was also due from the date the VAT threshold was achieved.
To prevent further implications, the incumbent will cease trading on 31 August 2022. As Medway is subject to a very limited Day Care services market and the incumbent cares for 40 Working Age Adults who may otherwise be subject to escalated alternative services, there's only a single economic entity who can deliver the required service as outlined in section 5 of this notice.
The arrangement will be for a period of 12 months with the option to extend for a further 6. This will allow the Council to establish a Dynamic Purchasing System to help develop the local Day Care market thereafter. |
