CCS072 Children in Care (D2N2) - Residential Placements
Authority: Derbyshire County Council (Local council)·On behalf of: Nottinghamshire County Council
What is being bought
Published requirement descriptionThis is a Framework opportunity for OFSTED registered Residential providers to support the D2N2 collaborative in the delivery of Good and Outstanding quality, stable and local placements to our Children in Care.
Background D2N2 Children in Care Framework is a collaboration between the following Councils: Derby City Council; Derbyshire County Council; Nottingham City Council and Nottinghamshire County Council, for the provision of Residential placements across the D2N2 boundary. D2N2 is working together to optimise the commissioning of placement provision for their children in care.
This is subject to governance approvals within each local Council
The Councils have worked together over the last decade on the provision of residential placements for Children in Care. Through this work it was recognised that there were shared challenges, gaps in provision and common needs amongst the collective Children in Care population, and the need of a combined approach and closer coordination across our area.
Current number of Looked After Children and Young People 0-18 supported in Ofsted registered Children's Homes is 427
This contract may be impacted by Local Government Reorganisation (LGR). Under the Procurement Act, schedule 8, the contracting authority may, if required, novate the contract to a successor council or modify it to meet the needs of any new council arrangements resulting from LGR. The precise form of any such novation or modification cannot be determined at this stage. Any changes will be implemented in accordance with the relevant regulations and contractual provisions.
- The authority expects to re-tender this requirement around 1 Jun 2033, 23:59 BST.
- No preliminary market engagement: Market engagement event took place in early April 2025. Initially the fostering and residential placements were forming into one framework, however upon engagement it was identified that these placement areas should be separate frameworks. Published description of the framework
This will be an open framework scheme commencing on 1 April 2026, with the initial framework in the scheme, and expiring after a maximum period of 8 years. The Council will award a minimum of three additional "pre-scheduled frameworks" at two-year intervals during the term of the open framework scheme. Please note: The Councils' reserves the right (at their own discretion) to include additional non-pre-scheduled frameworks within the scheme based on ongoing assessments of required capacity.
Following the establishment of the framework, Providers may use the tendering process for subsequent frameworks in the framework series to both
apply to join the framework or to update their original submission. Where an established framework provider chooses not to submit a new Tender the Council will, unless otherwise instructed in writing by the Provider, automatically add them to the next framework in the series based on their previous application.
For clarity any legislative changes that would cause this to change will be communicated within appropriate timeframes. In such an event the Council will have the right to terminate the framework upon giving appropriate notice.
Further Competition Call-offs
Referral Process:
(a) The commissioning Council will identify the framework providers who could deliver the service in the location required, at the appropriate cost, staffing ratio and who meets the specific requirements of the child.
(b) All identified providers will be sent information on the further competition call-off opportunity. Please note where deemed appropriate this information may include a maximum budget for the individual placement that is below that maximum framework price for the size of home.
(c) Any providers interested in the opportunity will respond with their bid, as soon as possible, and in line with what is stated on the referral.
Please note as set out above, the prices submitted by providers for further competition call-off opportunities shall include a total price and a breakdown of cost and shall be capped at the rates submitted by the provider as part of the application to join the framework and by any stated budget for the placement.
(d) The commissioning Council will assess responses and select the successful supplier based on the following criteria (in order of precedence unless otherwise stated):
(i) Suitability to meeting the child's needs to ensure the placement is in line with child's care plan. This will include but not be limited to consideration of matching, location and Ofsted grading.
(ii) Price
An offer will be made to successful tenderer, and where possible,
unsuccessful tenderers shall be advised of the outcome.
Direct Award Call-offs
Referral Process
(a) The commissioning Council will identify a specific framework provider who could deliver the service in the location required, staffing ratio and who meets the specific requirements of the child
(b) An assessment shall be made to identify which provider best meets needs of the Council, based on the following criteria (in order of precedence unless otherwise stated):
(i) Suitability to meeting the child's needs to ensure the placement is in line with child's care plan. This will include but not be limited to
consideration of matching, location and Ofsted grading.
(ii) Price
(a) An offer will be made to identified tenderer, either by email, or telephone, setting out the time period for providing a response. Please note where deemed appropriate the offer may include a price for the individual placement that is below that maximum framework price the Provider submitted at the time they joined the framework.
(b) The provider shall provide a response within the time period set out by the contracting authority in the offer.
In the event that the supplier does not response within the stated timescales or declines the offer, the above process will be repeated with the supplier who next best meets the requirements, or the Council may use the further competition option to establish the placement.

- Price carries 60 of 100 points: a 10% discount moves about 6 points. This one is won on the number: sharpen the price before polishing the prose.
- “CCS072 Children in Care (D2N2) - Residential Placements” is a framework: the contest is a place on its panel, not a single contract: call-offs may be direct or by further competition.
Price arithmetic assumes straight proportional scoring; the tender pack may use another formula.

Other external factors, outside of the control of the Council and Provider on a global, national, regional or local level which would require changes to the way in which the contract is performed or the costs associated with delivering services.
Whilst the categories outlined in this specification are registered children's homes and are categorised in terms of size of home, a known unknown is that there is also the growing requirement for OFSTED registered residential family centres. This may therefore result in procurement of such provisions within this framework at a future date
