The Support Capabilities and Commodities Team within the National Armaments Director Group (NAD) , part of the UK Ministry of Defence (the “Authority”), intends to extend contract ACCOMM/00087 (the Contracts) for the Provision of Engineering and Logistic Support to Aircraft Arrestor Systems in use in the UK and at overseas military bases – Rotary Hydraulic Arrestor Gear (RHAG) and Portable Hydraulic Arrestor Gear more…
(PAAG) and contract ACCOMM/00035 (the Contracts) for Arrester Barrier with Marshall Land Systems Ltd (“Marshall”). The extension will be for 24 months with an estimated value for the extension period only of £5.6 million excluding VAT. The two contracts were competitively let, and the Authority will combine the two contracts into one as part of this extension. It is considered that an extension can be placed under Section 41 of the Procurement Act 2023 because the direct award justification specified in paragraph 7 of Schedule 5 (single supplier – additional services) applies. The Arrester Barrier System is obsolete; Marshall, as the incumbent, has the necessary technical understanding of the Arrester Barrier System, Suitably Qualified and Experienced people, and access to the technical drawings and approved repair instructions from the OEM to provide the service. As such a change in supplier would result in the Authority receiving services that are both different from, and incompatible with, the existing services. Due to the age of the equipment, only Marshall holds the necessary technical information, know-how, and expertise, and can provision the required compatible spares. As such, the difference and incompatibility of a different supplier’s services would result in disproportionate technical difficulties in operation and maintenance of the Arrester Barrier System.
