Procedure rationaleThe Secretary of State for Defence (the “Authority”) intends to enter into a Contract extension with Babcock International Group Ltd (“Babcock”). Contract MSS/027 between the Authority and Babcock (the “Original Contract”) was entered into on 23/06/17 following a failed competition. Under the Original Contract Babcock Provides In-service Support (spares, repairs and post design services) of Secondary Propulsion Systems fitted to HM Submarines. The original Contract Term is due to Expire and for the reasons set out below the Authority intends to extend the original Contract for a period of 12 months to enable the finalisation of the follow-on support Contract that has been delayed.
It is Considered the Contract Extension can be placed using the negotiated procedure without prior publication of a Contract Notice pursuant to Article 28(1)(a) of Directive 2009/81/EC (Regulation 16(1)(a)(i) of the Defence and Security Public Contracts Regulations 2011)(Additional Supplies) This decision has been made due to the original Contract being run under the Competitive procedure and subsequently due to the absence of tenders was awarded on a single source basis to Babcock. The extension will allow the Authority sufficient time to explore the market for the follow-on support contracts without a break in service provision. The Scope and Terms of the original Contract remain unchanged. |
