Published requirement description

YPO has appointed suppliers to a Framework Agreement following a Competitive Tendering Procedure for the supply of Winter Maintenance Products and Services to the public sector. This Framework is designed to meet the needs of YPO and Other Contracting Authorities. The framework includes stock and contractual lots. Stock products are to be supplied to YPO's warehouse in Wakefield or by direct delivery to YPO customers. For contractual lots, Contracting Authorities will specify their individual supply arrangements for goods and/or services in their call-off contracts.

Who may buy through it

Any contracting authority that is subject to the Procurement Act 2023 (PA23) may use this framework.

This includes all organisations that fall within the definition of a "contracting authority" under PA23, such as central government bodies, local authorities, NHS organisations, emergency services, education institutions, and other publicly funded or publicly controlled bodies.

Published description of the framework

For an Award Without Competition, a mechanism for determining price payable will be as follows:

Prices for this Framework Agreement must be fixed for an initial period of twelve (12) months. After this initial period YPO will allow for an annual price re-fresh. YPO must be informed about any changes to pricing at least forty five (45) days in advance. Any abnormally low or high pricing must be backed up by appropriate evidence. Updated pricing information will be then used by any Contracting Authority wishing to Call-Off from this Framework Agreement. YPO and its customers reserve the right to reject prices which are deemed unsustainable.
Prices subject to annual prices re-fresh will be re-evaluated. The new pricing score will be combined with qualitative scores (non-cost/price scores) from the initial Framework evaluation stage. This may result in changed Supplier ranking for the following year. Contracting Authorities will then apply new ranking to make an award
Suppliers who fail to submit refreshed pricing and/or confirm that their existing pricing still applies within timescales required, will be excluded from Award Without Competition Call-offs for the following year.

The mechanism for Supplier selection under a Competitive Selection Process by OCAs or YPO will be as follows:

1.Only Suppliers awarded to the specific Lot for which the Contracting Authority is conducting a Competitive Selection Process (i.e., Lot 4, Lot 5 or Lot 6) will be invited to compete. Suppliers will only be invited to participate in competitions for the Lot(s) to which they have been formally awarded under the Framework and will not be invited to compete for any other Lots.

Suppliers invited to a Competitive Selection Process will be required to submit sealed bids via the Contracting Authority's chosen e‑tendering platform. Each time the Contracting Authority or YPO runs a Competitive Selection Process, the award decision will be made in accordance with the award criteria specified in the Tender Particuars.
