Regulation 72(1)(c) of the Public Contract Regulations 2015 allows for a modification to an existing contract to be made, where a reasonable contracting authority could not have foreseen the circumstances within which it finds itself. The Awarding Authority will extend the original contact term on the basis they and associated commissioners have been unable to undertake preparatory procurement activity due to the extensive impact of the Covid-19 pandemic on commissioning resource, most of which in Surrey has been redeployed to COVID-19 testing and vaccination programmes. The immediate impact of the pandemic on this service and the continuing longer term effects have resulted in a greater need to reconfigure for optimum delivery of children's community health services in a new environment which could not have been anticipated by any diligent contracting authority.
