Procurement Act 2023, Schedule 5, Paragraph 7 states the public contract concerns the supply of goods by the existing supplier which are intended as an extension to, or partial replacement of, existing goods where a change in supplier would result in the contracting authority receiving goods that are different, or incompatible with, the existing goods and the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance. The goods in this requirement are replacements for old and unreliable equipment which are required to interface with existing systems. Replacement with equipment from this manufacturer ensures compatibility is maintained and existing maintenance contracts are utilised.
