Procedure rationaleNegotiated procedure without prior publication1. The COVID-19 outbreak is a Public Health Emergency of International Concern as declared by the World Health Organisation on 30 January 2020. The WHO Director General characterised COVID-19 as a pandemic on 11 March 2020.2. DHSC is satisfied the tests permitting use of the Negotiated procedure without prior publication (Regulation 32(2)(c)) are met:A: As far as is strictly necessary: This item is a critical component to the clinical waste disposal process at the lab, core to its operation in a safe manner. Without this item, the lab cannot be operational with the void in the sample testing waste disposal process.B: There are genuine reasons for extreme urgency: The Government announced its drive to hit Mass Test Targets of 3,000,000 tests per day by January 2021 and the potentially prolonged impacts of the COVID pandemic if it fails to do so. C: It is impossible to comply with the usual timescales in the PCR: Due to the urgency of the requirement to ensure lab operation within the desired timescales, time doesn’t allow to comply with required process under the PCRs. This would not meet the required timescales and as such lab operation as intended would be compromised.D: The situation is not attributable to the contracting authority: This is a niche requirement which can only be achieved via the one supply source (Ezi-Dock) to meet the necessary containment capability to maintain safety and risk standards in these unprecedented times. |
