Procedure rationaleRegulation 32(2)(b)(ii) of the Public Contracts Regulations 2015, whereby a direct award may be made without prior publication:
‘where the works, supplies or services can be supplied only by a particular economic operator [i.e. contractor] for any of the following reasons…[which include where] ‘competition is absent for technical reasons’.
Under this Report, the services can be supplied only by a particular economic operator (i.e. CaterPlus) for the reason that competition is absent for technical reasons.
Recital 50 of the Public Contracts Directive 2014, provides assistance to the applicability of this Regulation 32, which could include, for example, a near technical impossibility for another contractor to achieve the required performance, or the necessity to use specific know-how, tools or means which only one contractor has at its disposal. |
