      "features": "Portsmouth City Council, (the Council) has decided to utilise a two-stage Competitive Flexible Procedure to establish 3 lots under the framework,  consisting of the following stages: \n• Stage 1 - a discrete Conditions of Participation stage to limit the number of suppliers to a maximum of 8 per lot.\n • Stage 2 - a Tendering Round with up to the top 6 suppliers being awarded a place on each lot of the framework (Up to 4 suppliers on tier 1, and 2 suppliers on tier 2).\nStage 1 - Conditions of Participation Stage This stage focuses on shortlisting suppliers that meet the necessary technical, financial, and operational capabilities required by the contract. It aims to reduce the number of bidders through consideration of meeting the conditions of participation and level of relevant experience and contract examples. \nIn the event that there are less than eight suppliers who meet the Conditions of Participation criteria for any Lot, the Council reserve the right to:\n•\tproceed to the second stage of the tender process for that Lot regardless, providing there are more than four qualifying suppliers; or\n•\tremove the impacted Lot from the Framework, if less than four qualifying suppliers, without impact on the remainder of the Lots progressing through the procurement process\nThe Council also reserves the right to determine the final number of contractors appointed to each Lot and the structure of tiering. This may include (but is not limited to) establishing a Lot without a Reserve Tier, where this is considered appropriate based on the number and quality of compliant tenders received. As a minimum for Framework viability, a Lot must contain a minimum of 2 Delivery Tier suppliers\nAny interested suppliers will need to register on the governments Central Digital Platform for the Council to review any potential grounds for exclusion and conduct a debarment check.  \nThe Council will be required to undertake checks on any named subcontractor a supplier incorporates into their bid. If the subcontractor was to meet the exclusion grounds and/or be listed on the debarment list, then the Council will need to investigate this as part of any award decision. This approach is most likely to be used on Lot 1a or possibly Lot 2 where the work scope is low value & low complexity.\n•\tCost and Quality Bid - Evaluation is split between project specific cost and quality elements (but not necessarily equally). \tEvaluation weightings are project specific and will likely differ from those used at Framework set-up. This approach will be used in most circumstances for Lots 1b and 2, and for more complex works Lot 1a where approaches to the work may significantly differ between Suppliers.\n•\tHigh Quality Focused Bid - Evaluation will focus on quality and experience. The decision of which Lot to progress a call-off procedure with will mostly consider the complexity and risks associated with the work type/scope of the contract. Where appropriate an expression of interest may be used, however, a decision will result in the selection of one Lot and will progress a call-off with either Lot 1a OR Lot 1b and will not be a hybrid of the two.\nThe Framework will also likely allow for calls for competition using cross-Lot or cross-Tier features, mainly when the nature or value of the call-off was not tested at Framework set-up. It is not intended for this to be commonplace. Portsmouth City Council (The 'Council') will be the host Authority for the Framework and has published this Preliminary Market Engagement (PME) Notice in accordance with the Procurement Act 2023. \nPrior to commencing the formal procurement process to establish the new framework agreement Coastal Partners are seeking input from the market on options for the scope, procurement, structure and operation of the agreement. This feedback will be used to inform the development of the final technical, procurement, contractual and commercial strategy. \nFRAMEWORK STRUCTURE & CALL OFF OPTIONS\nBroadly, the scope of the framework will be divided across two specialisms and divided into three Lots: \n•\tLot 1a - Minor Coastal & Flood Civil Engineering Works (~£10k-£100k call-offs)\n•\tLot 1b - General Coastal & Flood Civil Engineering Works (~£250k-£5M call-offs)\n•\tLot 2 - Specialist Beach Management Works (£50k - £1M call-offs)\n4 contractors will be appointed onto the primary tier with 2-4 appointed onto the secondary (reserve) tier for each of the proposed framework Lots. The inclusion of extension options is to allow for alignment with future EA funding cycles in the event of significant changes and / or restructuring of SCG membership, requirements, accountable body status, etc. as a result of Local Government Reorganisation which could delay future re-procurement. \nThe framework agreement will be let using the NEC4 Framework Contract with the following contract form call-off available for use as appropriate:\n•\tNEC4 ECC and ECSC\n•\tNEC4 TSC and TSSC\n•\tStandard Authority PO T&Cs for low value, low complex works\nFixed NEC4 Fee tendered at framework establishment will apply to future call contracts on a meet or beat basis. Local Authorities are being encouraged to adopt more term service contracts for beach management activities which may result in a lesser number of higher value contracts. \nFRAMEWORK ACCESS\nThe Framework is being established primarily for use by SCG/SCOPAC member Contracting Authorities, which currently includes:\n•\tBournemouth Christchurch and Poole (BCP) Council\n•\tChichester District Council\n•\tDorset Council\n•\tEastleigh Borough Council\n•\tFareham Borough Council\n•\tGosport Borough Council\n•\tHampshire County Council\n•\tHavant Borough Council\n•\tIsle of Wight Council\n•\tNew Forest District Council\n•\tPortsmouth City Council\n•\tSouthampton City Council\nThe framework, however, will also be accessible to all Contracting Authorities within the Southern and Wessex Regional Flood and Coastal Committee's (Southern RFCC, Wessex RFCC), regardless of SCG/SCOPAC membership, which currently includes:\n•\tHampshire\n•\tDorset\n•\tWest Sussex\n•\tEast Sussex\n•\tIsle of Wight\n•\tKent\n•\tSomerset\n•\tWiltshire\nThe framework will be worded so that Contracting Authorities under future iterations of SCG/SCOPAC membership and the Southern RFCC, will be able to access the Framework for its duration following changes as a result of Local Government Reorganisation or other factors.\nFRAMEWORK ESTIMATED DEMAND\nThe following demand and value estimates for each Lot have been taken from analysis of spend under the 2022-2026 Minor Works Framework, known needs from SCG Members and with consideration of EA funding rule changes expected in April this year:\n•\tLot 1A - Average of 10-20 call off contracts per annum / £500k - £1M total spend per annum\n•\tLot 1B - Average of 5 - 10 call off contracts per annum / £2M - £5M total spend per annum\n•\tLot 2 - Average of 5 - 10 call off contracts per annum / £500k - £1M total spend per annum\nOver the maximum 6 year term of the framework agreement spend could therefore equate to £42M. However, in order to account for year on year inflation, above estimate Lot 1B demand due to changes in EA funding allocation and wider use of the framework by Southern and Wessex RFCC members who are not currently members of SCG/SCOPAC an upper framework estimated value of £75M is likely to be stated within the subsequent Tender Notice. \nPROCUREMENT STRATEGY & PROGRAMME\nThe procurement process undertaken to let the framework agreement will either be on the basis of an Open Procedure or Competitive Flexible Procedure (CFP) procurement.
