Procedure rationaleThe City and County of Swansea (the Council) is the project lead organisation to deliver real time passenger information (RTPI) screens on behalf of the Welsh Government for the Swansea Bay & South Wales Metro System. The Council’s requirement for RTPI must be procured prior to the end of the 2023/24 financial year due to funding constraints and must be compatible with the Council’s current system and the RPTI system engineered and deployed by Transport for Wales (TfW) and Journey in Partnership. The TfW system is being fully deployed within the next few months.
The Council considers that Regulation 32(2)(b)(ii) which permits the use of the negotiated procedure without prior publication to award public service contract where competition is absent for technical reasons will apply here. The Council requires a supplier who can provide a solution which can deliver on the technical requirements of the Council’s existing system and that also is compatible with the TfW central system. Journey in Partnership are the only organisation who can provide the technical requirements and additionally they own the proprietary rights to the TfW system.
Regulation 32(2)(b)(ii) applies where there is no reasonable alternative or substitute and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. The Council has considered the market and there are no reasonable alternative providers who can provide the technical services required. The TfW Framework Agreement for the provision of such services will be in place in the coming months and the Council currently foresees that it will procure future services via the TfW Framework Agreement.
