Why no open competition

The works, supplies or services can be provided only by a particular economic operator due to absence of competition for technical reasons

Published justification

PSNI will rely on Regulation 32 (2) (b) (ii) and (iii) as the supplier owns proprietary rights and in addition Regulation 32 (5) (b) as vendor alignment must be maintained with other UK Forces and AGS (An Garda Síochána) to provide technical interoperability and allow data exchange capability.

Review and risk notes
Review procedure

The Public Contract Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). The authority incorporates a standstill period (i.e a minimum of 10 calendar days) before this contract is awarded.
