- Service contract to be awarded to the winner or one of winners under the rules of a design contest
- Published justification
The contract was awarded without prior publication of a contract notice on the basis that competition is absent for technical reasons.
The contract consolidates and co-terminates three existing software services that are already supplied by the contractor and are embedded within the University's operational and business processes. The services form part of the University's existing software environment and are integrated with established configurations, user permissions, workflows, reporting arrangements and support arrangements.
Awarding the contract to an alternative supplier would require migration from the incumbent systems, significant reconfiguration, data migration activities, user retraining, implementation of replacement solutions and disruption to established operational processes. The University concluded that changing supplier would create substantial technical difficulties and material risks to the continuity, stability and effectiveness of these critical services.
The University considered the available options and determined that only the incumbent supplier could provide the required continuation of the existing services without disproportionate technical disruption. The direct award therefore ensures continuity of service and maintains the integrity of the University's existing software environment.
As part of the award, the University has aligned the contract terms for the three services into a single co-termed arrangement, which simplifies contract management and delivers improved commercial value. However, the principal justification for the absence of competition for technical reasons and the need to maintain continuity of the University's established software services.
