Procedure rationaleThe Single Tender Action is being undertaken due to the exit date for the current contract with Bryson Recycling, and the need to ensure continuity of service provision until the Council has implemented and transitioned to its preferred kerbside collections model. Please be advised that the Council are currently engaging with key stakeholders in relation to the preferred collections model.
Justification:
1) There is genuinely only one provider who is capable of meeting the requirement or will be interested in doing so (PCR 2015 Regulation 32(2) General Grounds, (b) (i)(ii)(iii).
2) In the case of an individual contractor where it is necessary for business continuity to retain a specific individual; (PCR 2015 Regulation 32 (5) (b)) supply contracts.
Bryson Recycling have been the Councils sole service provider for its kerbside sort service for a considerable number of years and in the last open tender competition for the Council's kerbside sort service were the sole tenderer. The STA contract period would not incentivise other economic operators to enter the market, given the significant costs associated with resourcing a kerbside sort contract and the planning and mobilisation period that would meet the contract start date.
A standstill period of 10 working days will be implemented by the Council prior to contract award. The last day of the mandatory standstill period is 11 September 2023.
The first day on which LCCC can enter into the contract (assuming no relevant proceedings have been served) is 12 September 2023. |
