- Why no open competition
- The procurement falls outside the scope of application of the directive
- Published justification
The initial contract was procured and awarded pursuant to the requirements of the Public Contracts Regulations 2015 ('PCR 2015'). The PCR 2015 provide exemptions under which a contract may be compliantly modified without a new procurement procedure.
The original contract has previously been modified twice, a further modification would not be permitted as this would take the total modified cost to over 50% of the original contract value.
The predominant cause of the increase in work required under the contract is due to the Combined Authority agreeing to undertake the public realm improvements at Monument Place that were proposed to be undertaken by Liverpool City Council. There is public benefit in doing so due to cost efficiencies and reduced public disruption.
Consideration has been given to alternative arrangements but the proposed additional work cannot be easily discoupled from existing work. A new tender process is not feasible in the circumstances. Officers believe that failing to undertake an ECI stage will create a significant risk to the deliverability of the Project given the budget difficulties it already faces.
