Procedure rationaleIt is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) and 32(2)(c) Directive 2014/24/EU (Regulation 32 (2)(b)(ii) and Regulation 32 (2)(c) of the UK Public Contracts Regulations 2015). The contract may only be awarded to the Contractor due to technical reasons and for reasons of extreme urgency including the need to utilise specific know-how, tools, processes, infrastructure and the expertise of suitably qualified specialised personnel, which only the Contractor has at its disposal and the fact that the Contractor is the only supplier who holds the necessary MAOS (Maintenance Approved Organisation Scheme) accreditation for the Lancaster B1 aircraft required by the Authority to satisfy its obligations under the relevant Military Aviation Authority Regulations. To accredit any other provider would take a minimum of 18 months and thus not meet the Authority’s required programme timetable. |
