What is being bought2 lots · detail below
Published requirement descriptionThis notice relates to the permitted modification of existing contracts under the Provider Selection Regime (2023), to enable additional access to Mandatory Dental Services (MDS) within NHS Surrey Heartlands ICB on a recurrent basis, in response to recent contract terminations and in accordance with the NHS 2023/24 priorities and operational planning guidance requirement to "Recover dental activity, improving units of dental activity (UDAs) towards pre-pandemic levels".
The Commissioner considers that the modifications are permitted by Regulation 13(1)(c) of the Provider Selection Regime (2023), where the modification has been made in response to external factors beyond the control of the authority and the provider, and that the modifications do not render the contracts materially different in character. The scope of the contract has not been extended as the services provided remain materially the same.
This notice has been published in line with Regulation 13(4)(c) and Schedule 12 of the Provider Selection Regime (2023).

Publisher note: These award decisions have been approved by NHS Surrey Heartlands ICB's Dental Commissioning Manager and Senior Delegated Commissioning Manager. One declaration of potential conflict of interest was made via the conflict of interest process for this procurement and recorded accordingly. The non-conflicted members of the procurement have assessed the nature and risk of this conflict, and have decided which steps to take to avoid or mitigate it. The declaration was deemed as not being an actual conflict of interest. This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the contract modification provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.
