Why no open competition: The works, supplies or services can be provided only by a particular economic operator due to absence of competition for technical reasons; Extreme urgency brought about by events unforeseeable for the contracting authority/entity and in accordance with the strict conditions stated in the directive
Published justification: The Chinese Government maintains strict travel restrictions in China due to the ongoing Covid pandemic. Ulster University are unable to fulfil their teaching commitments in China due to these travel restrictions. This DAC is necessary to ensure that Ulster University Business School’s contractual obligations with HGU and the Ministry of Education in China are met. China Intellectual Education Institute are the incumbent suppliers and have demonstrated their ability to provide teaching services in line with the quality requirements as laid out in the MOE Contract and in line with Ulster’s Recognised University Teacher processes.

Review and risk notes

Review procedure: The University incorporated a minimum 10 calendar days standstill period at the point information on award of the contract was communicated to all tenderers. The standstill period provided time for unsuccessful tenderers to challenge the award decision before the contract was entered into. The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (Northern Ireland).
