It has been determined that the appropriate route to market for this requirement is the use of the negotiated procedure without prior publication in accordance with The Public Contracts (Scotland) Regulations 2015, Regulation 33 – Use of the Negotiated Procedure without Prior Publication; - (1) A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases - b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (ii) competition is absent for technical reasons.

An economic operator that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contract (Scotland) Regulations 2015 (SSI2015/446) (as amended) may bring proceedings to the Sheriff Court or the Court of Session.
Publisher note: In line with 72 - Modification of Contracts During their Term, of the Public Contracts (Scotland) Regulations 2015, this Contract may be modified without a new procurement procedure in accordance with this Part in some cases. (SC Ref:737837)
