Procedure rationaleRegulation 33(8)(a) of the Public Contracts Regulations 2015 (PCR 2015) sets out the criteria for making a direct award:
all the terms governing the provision of the works, services and supplies concerned are set out in the framework agreement, and
the objective conditions for determining which of the suppliers on the framework agreement shall perform them are set out in the procurement documents.
BMBC will ensure that it follows the framework conditions in ensuring that the chosen supplier provides best value for money.
‘Direct Award’ is the common phrase used for the ‘use of the negotiated procedure without prior publication’ process as stipulated in the Public Contract Regulations 2015 (PCR 2015).
Technology Products and Associated Services 2 (TePAS 2) allows Direct Awards to be placed under the framework agreement. There are no governance barriers in place for using TePAS 2 as a Direct Award route to market; however a Direct Award must be deemed appropriate for your requirements.
