The items are unique to the HMT range of vehicles of which Supacat Ltd are the original equipment manufacturer and owner of the vehicle IP, so is the only supplier that can supply the services required. Furthermore, paragraph 6 of schedule 5 is relied upon due to there being an absence of competition because no other provider possesses the technical know-how and data necessary to perform the requirement without introducing an unacceptable level of risk to operational safety and MOD operational requirements. There is no reasonable alternative supply because the product supplied is to be fitted to a vehicle of which the Supplier is the designer and manufacturer and no alternative available product.
