Procedure rationaleIt is considered that this contract can be awarded under Section 41 of the Procurement Act 2023 because the direct award justification specified in paragraph 7 of Schedule 5 (single supplier – additional or repeat goods of services) applies. This is because Thales is the Original Equipment Manufacturer (OEM) of the Pods and is the existing supplier. MOD intends to procure additional Pods that are integrated with existing Thales‑managed ground equipment and in-service platforms. These are critical to maintaining launcher operator training capability. Sourcing Pods from a supplier other than the OEM would result in MOD receiving goods that are incompatible with existing systems, which would result in disproportionate technical difficulties in operation.
