- Why no open competition
The works, supplies or services can be provided only by a particular economic operator due to protection of exclusive rights, including intellectual property rights
- Published justification
Due to technical reasons as the supplier One Advanced own exclusive rights to the Evolution legal case management system which has
been heavily bespoked for CSO. On this basis there are derogations under the regulations to award a contract to a single supplier where
the supplies or services can only be supplied by a particular supplier for the following reasons:-
i) Where competition is absent for technical reasons (regulation 32(2)(b)(ii); or
ii) For reasons connected with the protection of exclusive rights, including intellectual property rights (regulation 32(2)(b)(iii))
- Review procedure
The Public Contract Regulations 2015 provide for aggrieved parties who have.. been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). The.. authority will incorporate a standstill period (i.e. a minimum of 10 calendar days) before this contract is awarded.
