Contract terms summary

Invoices are to be submitted to the Council, in accordance with the Prices and Payment clause in the Conditions of the Framework. Payment will normally be made within thirty (30) days of receipt of a correct invoice.

Risks

In furtherance of the UK Government’s plans for English devolution, Hertfordshire County Council (HCC) is consulting on plans for the reorganisation of local government structures in its county. This reorganisation may result in the county, district and borough councils of Hertfordshire being re-organised into a multi tiered unitary authority. HCC is required to submit its full plan for re-organisation to UK Government by November 2025, and any changes are estimated to take effect in April 2028 (although this is subject to change). Such changes could directly affect the structure, scope, or continuation of the contract beyond 1st April 2028. Whilst it is anticipated that existing contracts will be novated to the replacement authority, HCC can offer no guarantee at this stage.

    • Response Rate for Audits, 1. The Contractor is responsible for ensuring that a minimum 95% response rate of the audits is achieved and maintained. Failure to provide a minimum of 95% return across more than 2 (two) consecutive collection periods or more than 4 (four) times in a year (a year is measured from April 1st to March 31st) will result in a rectification notice being issued.
    • Action Plan re Rectification Notice, 1. Pursuant to Clause 36.6, the Contractor shall produce the Action Plan within forty-eight (48) hours of receiving the Rectification notice. The Contractor must then produce an action plan to be approved by the Council’s Contract Manager who may require specific amendments to the Action Plan which must ensure a 95%+ return for each of the following 3 (three) months. For the avoidance of doubt August is excluded for the purpose of the 3 (three) months, schools as it is counted as the summer break.
    • Quality Inspections, 1. The Contractor is responsible for carrying out Monthly quality inspections for each site. The quality inspections are to be signed and scored by a representative from the site using the contractors Quality audit document. The contractors will be required to score 75% and above score on their audit for it to be deemed satisfactory. Hertfordshire Contract Management Services are to be made aware of audits that score lower than the 75% pass mark.
