The provider is a NHS Foundation Trust, providing acute health care services including, but not limited to, Commissioner Requested Services (CRS) / Essential Services and specialised services. The provider is the only provider capable of delivering the services due to the nature of those health care services. Additional funding from NHS SEL ICB added to the Contract Value brings the revised annual total Contract Value to £1,211,554,000.
Under the Provider Selection Regime (PSR) Regulations 2023, there is no formal procurement challenge or standstill period applicable to this contract modification. Any concerns regarding the decision-making process should be raised promptly in accordance with the NHS South East London Integrated Care Board's internal governance procedures.

Publisher note: The provider is an NHS Foundation Trust delivering acute healthcare services, including but not limited to Commissioner Requested Services (CRS) / Essential Services and specialised services. Due to the nature of these healthcare services, the provider is the only organisation capable of delivering the required services. Additional funding from NHS SEL ICB has been added to the contract value, resulting in a revised annual total contract value of £1,211,554,000. This represents an increase in contract value of over £500,000. This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified. The decision to modify this Contract was approved by the SEL ICB GSTT Contract Management Board, and the Contract signed by SEL ICB Chief Executive Officer. No conflicts of interest were declared, noting SEL ICB's 'Standards of Business Conduct' policy is in line with arrangements outlined within the SEL ICB constitution to support the integrity of decision-making processes and help staff manage conflicts of interest risks effectively. No conflicts of interest were declared in relation to the decision, in accordance with the SEL ICB Standards of Business Conduct and governance arrangements

There have been no prior material modifications affecting the overall scope of the contract., Need for additional works, services or supplies by the original contractor/concessionaire: The services under this contract are delivered by an NHS Foundation Trust providing integrated acute healthcare services, including Commissioner Requested Services (CRS) / Essential Services and specialised services. Due to the highly integrated nature of these services across hospital sites, there is no alternative provider capable of delivering the full scope of services to the required standard. A change of contractor would result in significant disruption to patient care, service continuity, and clinical risk. It would also lead to substantial duplication of costs associated with mobilising a new provider, including workforce transition, infrastructure, clinical systems, and governance arrangements. Therefore, for both technical and economic reasons, the existing provider remains the only viable organisation capable of delivering the services.
