• Change o Building an externally accessible API on the public website.
o Providing clear documentation, including example instructions for connecting JSON outputs to Excel.
o Integrating FCA-provided legal disclaimers regarding downstream usage.
o Discussing and, if required, implementing controls such as call-rate throttling or CAPTCHA-type protection.
o Addressing operational maintenance considerations relating to load and usage.
o Operation and support maintenance of the public API service, Need for additional works, services or supplies by the original contractor/concessionaire: The safe harbour under PCR 2015 Regulation 72(1)(b) applies here the basis that this variation introduces additional services and enhancements not included in the original contract scope but are necessary to maintain continuity and functionality of the FCA Handbook website. Changing the supplier at this stage would be impractical and would cause significant inconvenience and duplication of costs because:
o The incumbent supplier already hosts and manages the FCA Handbook platform, and transferring these services to a new provider would require extensive rework, data migration, and integration, resulting in operational disruption and additional expense.
o The enhancements are technically linked to the existing solution (See Appendix) and cannot be delivered effectively by an alternative supplier without duplicating work already completed.
o The price uplift for these additional services is within the 50% threshold of the original contract value, satisfying requirement under Reg72(1)b
