As detailed above, the HMP/YOI Doncaster contract is a Category B “Manage & Maintain” contract which is primarily a service-based agreement in which the provider is responsible for the day-to-day operation of the prison, including custodial services, facilities management, rehabilitation programmes, and staff provision.     • Change Whilst not a modification, the original contract value of £281,847,815 as per Contracts Finder: "Services Contract-Major Contracts-2011-Provision of Custodial Services for HMP/YOI Doncaster-0508" (published 20 February 2018), has been subject to annual indexation throughout the 15-year contract term in accordance with the contract. This indexation is the primary reason for the increase in the total contract value to £332,308,635 prior to the modification described in this notice. There have been no substantial changes to the terms of the contract since its award, however minor amendments will have been implemented in accordance with the contract’s change protocol procedure to account for changes to the Prison Estate across the 15-year contract term. The modification described in this notice is to extend the contract by 24 months from 1 October 2026 to 30 September 2028. — Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: Regulation 72(1)(c) The contracting authority became aware that commercially sensitive information had been inadvertently disclosed in a separate but similar government procurement, which created a material risk that the HMP/YOI Doncaster competition may have been compromised. The disclosure of this information was unforeseeable by the contracting authority on HMP/YOI Doncaster. An investigation was therefore required to address the issue, which could not be completed before expiry of the existing contract. In the circumstances, the operational imperative of certainty, safety and stability of the prison could only be achieved by cancelling the procurement and extending the current contract. A contract extension of 24 months is therefore required to re-procure and safely mobilise the prison whilst an investigation is completed. The extension of the current contract does not alter its overall nature and the increase in price does not exceed 50% of the original contract value. Regulation 72(1)(b) The extension has become necessary by reason of the matters set out above and a change of contractor cannot be made for technical reasons, namely the need for safe mobilisation and safety and stability in the prison pending re-procurement and completion of the investigation. Further, a change of contractor would cause significant inconvenience and substantial duplication of costs and the increase in price would not exceed 50% of the original contract value.
