- Why no open competition
Extreme urgency brought about by events unforeseeable for the contracting authority/entity and in accordance with the strict conditions stated in the directive
- Published justification
During an audit of our Fire Safety Compliance processes it was highlighted that annual and monthly testing on Emergency Lighting on 3 storey and above blocks of flats was required and had not historically been carried out. Contractors were urgently required to carry out annual and monthly testing to ensure the safety of tenants in social housing. Although a full procurement process was not completed, the market was approached and meetings held with the top ranked suppliers from three frameworks, these allowed for Direct Award. Bids were received from four suppliers. All had capacity to complete the work and gave us confidence that they could. The final decision was made on price.
Publisher note: The Authority is currently undertaking a tender process for the provision of Fire Safety services, including Emergency Lighting compliance checks. The procurement is in the evaluation stage and contract awards are anticipated within the next 3-4 months. Emergency Lighting compliance checks are a critical element of the Authority's fire safety obligations and are required to ensure the safety of tenants residing in the Authority's social housing stock. An interruption in service provision would expose the Authority to significant operational and compliance risks and could adversely affect resident safety. The proposed extension is therefore necessary to ensure continuity of service whilst the ongoing procurement process is concluded and replacement contracts are mobilised. The extension is limited to the minimum period required to complete these activities and does not alter the nature, scope or overall purpose of the existing contract.

- Change An extension of 6 months to allow for the tender process to end and a supplier be appointed. No change to value of the contract as the original value has not been fully utilised., Need for additional works, services or supplies by the original contractor/concessionaire: The incumbent contractor is fully mobilised, has received training on the Authority's contractor portal and is familiar with the sites and service requirements covered by the contract. Re-procuring a short-term interim arrangement whilst the ongoing procurement is completed would require additional mobilisation and administration and would not represent an efficient use of public resources. The extension is limited to the minimum period required and does not alter the nature, scope or overall purpose of the contract.
