Procedure rationaleThis contract is awarded in accordance with the following derogations under the regulations:
I. Where competition is absent for technical reasons (regulation 32(2)(b)(ii);
II. For reasons connected with the protection of exclusive rights, including intellectual property rights (reg32(2)(b) iii) but only where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
The Supplier has a developed position on IPR specific to the client and are the sole provider until a replacement system can be procured. The DAC will allow for ongoing maintenance, service development and ensure ongoing availability and functionality. |
