This is to allow for the provision of services required for the contract under the PCR 2015 Regulation 32(2)(b)(ii), where competition is absent for technical reasons and Regulation 32(2)(b)(iii),ii), for reasons connected with the protection of exclusive rights, including intellectual property rights.
- Review procedure
The Public Contract Regulations 2015 provide aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). The Authority has incorporated a standstill period before this contract modification is awarded. The standstill period will be for a minimum of 10 calendar days.
