- The procurement falls outside the scope of application of the directive
- Published justification
Fife Council requires to procure a solution for Mobile Workforce management that the Council has had in place for a number of years. The Council requires this solution to include dynamic scheduling amongst other features and the solution must integrate with a number of the Council's back office solutions. The Council believe there is only one supplier who can provide this. The attached document gives further details of the requirement.
- Review procedure
Economic operators should approach the contracting authority in the first instance. However, the only formal remedy is to apply to the courts:
An economic operator that suffers, or is at risk of suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 or the Procurement Reform (Scotland) Act 2014, may bring proceedings in the Sheriff Court or the Court of Session
