What is being bought
Watford Borough Council (the Council) intends to enter into a deed of variation to vary and extend the contract with Smidsy Ltd T/A Beryl (the Contractor) dated 22 October 2019 (the Underlying Contract) for the provision of a bike share scheme in Watford. The Underlying Contract was originally procured under Procurement reference BIP435546557 and published on 11 October 2019. The maximum total of this contract extension sum is £254,275 (£50,855 p.a. x 5 years) and would commence on 1 April 2026 when the current contracts ends (on 31 March 2026) for a period of 5 years with a rolling break clause from year 3 on 12 month’s notice.

The proposed extension would fall within the provisions of Regulation 72 (c) where all of the following conditions are fulfilled: — (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. (ii)the modification does not alter the overall nature of the contract. (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement.
